Coverage:
Your work comp policy has two parts:
- Worker's Compensation Coverage:
This part is designed to cover injury sustained by your employees while working for you. The coverage is without regard to negligence on your part. The coverage is governed by the California Labor Code and is not specifically outlined in the policy.
- Employers Liability:
This part is made available to employees who feel they were injured due to the gross negligence of their employer. California has a law that says Worker's Compensation is the sole remedy for employees which in essences says in CA an employee cannot sue under employers liability. There have been judgements that have overridden this law.
Family:
Many people think that they do not have to carry Worker's Compensation for family members. This is only true if the family member is a miner and is totally supported by am employer.
Rates:
Each insurance company sets its own rates for Worker's Compensation. Those rates have to be approved by the state before they can be used. |
